More Than a Law Firm—A Legacy of Advocacy
Thwaites Lundgren & D’Arcy is a general civil and trial practice law firm in New York committed to excellence and service. The firm was founded by Daniel Thwaites in 2003.
Fresh from Jamaica, Mr. Thwaites had begun his legal career in the United States with the Law Firm of Burke, Lipton, Puleo & McCarthy, in White Plains, NY where he worked as staff-counsel to Liberty Mutual Insurance Company, Wausau Insurance Company, Peerless Insurance Company, and Prudential Insurance Company. There he engaged in all aspects of insurance defense litigation, from inception to trial, with a particular expertise and focus on health-care law and regulation.
After working briefly on the side of the Insurance companies, Mr. Thwaites felt moved to represent injured people and the doctors that treat them for their injuries. He therefore launched his own boutique law firm specializing in the recovery of medical expenses for injured parties, and in the representation of wrongfully injured people.
Shortly thereafter, Mr. Thwaites was joined by Kurt Lundgren, who he had come to know as a senior litigator in the courthouse. They formed Thwaites & Lundgren, which became a successful force in litigating against insurance companies.
In 2010 the firm expanded again with the addition of Kevin D’Arcy, another Bronx courthouse insurance carrier litigator who decided he desired fighting against insurance companies and not for insurance companies.

Daniel Thwaites
Mr. Daniel Thwaites is the Managing Attorney and founding member of the firm, overseeing all aspects of civil litigation within the practice. He holds primary responsibility for new business development, client relations, human resource management, and managing complex negotiations with insurance carriers.
Originally from Jamaica, Mr. Thwaites maintains strong ties to his homeland. For many years he wrote a newspaper column for The Sunday Gleaner, Jamaica’s most prominent newspaper.
Mr. Thwaites is admitted to practice law in New York State, the U.S. Eastern and Southern District Courts, and Jamaica, West Indies.
Mr. Thwaites began his legal career in the United States with Burke, Lipton, Puleo & McCarthy, a White Plains, NY-based firm serving as staff counsel for Liberty Mutual Insurance Company, Wausau Insurance Company, Peerless Insurance Company, and Prudential Insurance Company. There, he specialized in insurance defense litigation, handling cases from inception to trial, with a particular focus on healthcare law and regulation.
Currently, Mr. Thwaites serves on the Board of Directors of the Morris Heights Health Center, a healthcare provider dedicated to serving underserved communities in the Bronx, New York City. Learn more.

Meet the Attorneys Who Don’t Back Down
Kevin D’Arcy is a partner at Thwaites, Lundgren & D’Arcy. He specializes in insurance litigation and has experience taking cases to trial and verdict on behalf of his clients in automobile, premises, and construction accidents.
Prior to joining the firm, Kevin worked at Liberty Mutual Insurance specializing in auto, premises, construction, and No-Fault law. He learned the adversarial nature of litigation and decided that he would prefer representing the interests of those injured rather than the interests of insurance companies.
Kevin is a competitive person. He attended a Federal Military Academy, USMMA, earning a Bachelor of Science and an engineering degree. After school, he served in the Persian Gulf War on supply ships in 1991-1992. His competitive nature also took him to Europe where he played professional basketball overseas for a year.
Thereafter, while finishing his military commitment, he attended New York Law School to obtain his Law Degree while working for the City of New York as an Engineer.
Kevin comes from a big family, and has a big family, and is always looking to increase his family and welcomes all clients as members of the extended family!
Kurt Lundgren, born Nyack, NY.; admitted at bar, 1993, New York; Education: Columbia University (B.A. 1983), Mississippi College School of Law (J.D. 1992 Practice Areas: Commercial litigation; Toxic Tort; Personal Injury; Insurance coverage issues; Insurance Litigation defense; Appellate Practice; Property Damage and Insurance Litigation; Medical and Legal Malpractice defense; and Health Care Law. Kurt Lundgren joined Mr. Thwaites in partnership in 2005. He is a member of the New York State Bar Association, the Bronx County Bar Association, and is admitted to the Southern and Eastern District Federal Courts. Prior to Mr. Lundgren’s career in law, he spent five years as a professional baseball player in the New York Mets Farm System. During that time, he also was a freelance writer for Popular Mechanics magazine.
After obtaining his law degree, he began his legal career as an attorney with the New York City Law Firm of Fischer, Fallon, Salerno, Betleski & Kelly working under partner the Hon. George Salerno (now a Bronx Supreme Court Justice). Thereafter, he worked as staff counsel for several insurance companies, including The American International Group (AIG), CNA Insurance Company, Frontier Insurance Company, and in the private practice with the Law Firm of La Sorsa & Beneventano.
His case load consisted of handling complex construction accidents, insurance litigation, professional liability litigation, property damage cases, medical malpractice defense, personal injury defense, and asbestos litigation throughout the country. Mr. Lundgren is a seasoned and experienced litigator, and has brought thousands of cases to successful conclusion.
